Purpose and acceptance
These terms govern access to, browsing of and use of the FluX informational website. Access is free of charge and requires no prior registration.
Browsing the site gives you the status of user and implies full acceptance of these terms in the version published at any given time. If you do not agree with them, we ask that you do not use the site.

What this document covers and what it does not
This document governs only the informational website on-flux.com: its contents, its forms and browsing through it.
Use of the FluX platform (app.on-flux.com) is not governed by these terms, but by the subscription agreement, the particular conditions of the contracted plan and the data processing agreement, documents that are provided and signed during contracting. Should those documents and these terms differ regarding the contracted service, the former prevail.

Permitted use
You undertake to use the site in accordance with the law, good faith and these terms. In particular, the following is not permitted:
- Entering false data or impersonating another person or entity.
- Carrying out bulk or automated extraction of content, reverse engineering, or any conduct that compromises the availability, integrity or security of the site and its systems.
- Introducing or spreading malicious code, or attempting to access unauthorised resources.
- Commercially exploiting the contents of the site without the owner's prior written authorisation.
Failure to meet these obligations may result in access to the site being denied, without prejudice to any legal action that may apply.

Contact forms
The forms on the site are for requesting commercial information or a product demonstration. By submitting them you declare that the data provided is truthful and that, if you include data of a third party or of the company you represent, you have sufficient standing to pass it on to us.
Submitting a form does not constitute contracting the service nor create any obligation for either party: it merely starts a commercial contact.

Merely accessing the site neither assigns nor transfers any right over those contents. Viewing them, and the technical reproduction needed for browsing, is permitted; any other use requires express written authorisation.

Informational nature of the contents
The metrics, improvement percentages, savings ranges and results shown on this site, including those of the return-on-investment calculator, are indicative estimates based on ranges that are common in the sector, offered for illustration.
They are not a binding offer, a contractual promise or a guarantee of results. Actual results depend on the specific circumstances of each operation. The financial and functional conditions that are binding will be exclusively those set out in the subscription agreement that is signed.

Availability and liability
FluX endeavours to keep the site running and up to date, but does not guarantee uninterrupted availability or the absence of errors. We may temporarily suspend access for maintenance or for technical reasons beyond our control.
FluX shall not be liable for damages arising from use of the site, except to the extent that applicable law does not allow such liability to be excluded or limited. In particular, nothing in these terms limits liability for wilful misconduct or gross negligence, nor the rights that consumer protection law grants on a mandatory basis.

Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute arising from access to or use of the website, the parties submit to the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction.
The foregoing is without prejudice to the mandatory jurisdiction that applies where the user qualifies as a consumer.
